Terms and Conditions of Sale

These terms of sale are concluded, on the one hand, by the company SASU DesignFeu with a share capital of €2,000, whose registered office is located at 14 rue Charles V, 75004 PARIS, registered with the Paris Trade and Companies Register (RCS) under number 845 212 836, hereinafter referred to as “DesignFeu,” operator of the website www.designfeu.com, and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.designfeu.com, hereinafter referred to as “the Buyer.”

Article 1. Purpose

These terms of sale define the contractual relationship between DesignFeu and the Buyer and the conditions applicable to any purchase made through the website www.designfeu.com. Purchasing a product via this site implies the Buyer’s unconditional acceptance of these terms of sale, which the Buyer acknowledges having read prior to placing an order. Before any transaction, the Buyer declares, first, that purchasing products on www.designfeu.com is not directly related to their professional activity and, second, that they have full legal capacity to enter into these terms and conditions of sale.

DesignFeu reserves the right to modify these terms of sale at any time to comply with new regulations or to improve the use of its site. Consequently, the applicable conditions will be those in force on the date the order is placed by the Buyer.

Article 2. Products

The products offered are those listed on the website www.designfeu.com of DesignFeu, subject to availability. DesignFeu reserves the right to modify the product assortment at any time. Each product is presented on the website with a description listing its main technical characteristics (size, color, composition, etc.). Photographs are as accurate as possible but are not binding on the Seller. The sale of products shown on www.designfeu.com is intended for all Buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices

The prices shown on the product pages of the online catalog are in Euros (€), US Dollars ($), or Pounds Sterling (£), inclusive of all taxes (VAT included), with a VAT rate of 20% applied. Any change to the VAT rate may be passed on to the price of the products. DesignFeu reserves the right to modify its prices at any time; however, the price shown in the catalog on the day of the order shall be the only price applicable to the Buyer. Prices do not include shipping costs, which are billed in addition to the price of the products purchased based on the weight and destination region of the order.

Article 4. Orders and Payment Terms

Before placing any order, the Buyer may create an account on www.designfeu.com. The account creation section is accessible directly from the menu bar. On each visit, if the Buyer wishes to order or view their account (order status, profile, etc.), they must log in using their credentials. DesignFeu offers the Buyer a multi-step ordering and payment process, with two payment options:

  • Secure payment by PayPal or bank card (via the PAYPAL system): the Buyer selects the products they wish to order in the “cart,” adjusts if necessary (quantities, references, etc.), verifies the delivery address or enters a new one. Shipping costs are then calculated and presented to the Buyer, along with the carrier’s name. The Buyer then chooses the payment method: “Payment by PayPal.” The next step allows the Buyer to review all information, read and accept these terms and conditions by ticking the corresponding box, then validate the order by clicking “Confirm my order.” Finally, the Buyer is redirected to the secure PAYPAL interface to enter their PayPal account or personal bank card details safely. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by PayPal account or bank card is irrevocable. In case of fraudulent use, the Buyer may request cancellation of the card payment; sums paid will then be re-credited or refunded. The cardholder’s liability is not engaged if the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card. To obtain a refund of the fraudulent debit and any bank fees incurred, the cardholder must dispute the charge in writing with their bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited are refunded by the bank within a maximum of one month after receipt of the cardholder’s written dispute. No refund fees may be charged to the cardholder.

Order confirmation constitutes acceptance of these terms of sale, acknowledgment of full knowledge thereof, and waiver of the Buyer’s own purchase conditions. All data provided and the recorded confirmation shall constitute proof of the transaction. If the Buyer has provided an email address on the order form, DesignFeu will send the Buyer an email confirming the order’s registration.

Article 5. Retention of Title

DesignFeu retains full ownership of the goods sold until full and final payment of the price, including principal, fees, and taxes.

Article 6. Right of Withdrawal

Pursuant to Article L121‑20 of the French Consumer Code, the Buyer has a period of fourteen working days from delivery of the order to exercise the right of withdrawal and return the product to the Seller for exchange or refund without penalty, with the exception of return shipping costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed geographic area. Delivery times are provided for information purposes only. DesignFeu may provide the Buyer with the parcel tracking number by email. Delivery is carried out by the carrier. The Buyer must check the condition of the packaging and the contents of the goods upon delivery in the presence of the courier. In the event of damage during transport, any claim must be made to the carrier within three days from delivery.

Article 8. After‑Sales Service (SAV) – Receipt, Damaged or Non‑Conforming Products

The provisions of this article apply without prejudice to the statutory guarantees of conformity and hidden defects available to the Buyer under Articles L.217‑3 et seq. of the French Consumer Code and 1641 et seq. of the French Civil Code. The absence of reservations upon delivery does not release the seller from these statutory guarantees.

8.1. Checks upon Delivery

Upon receipt, the Buyer must check the external condition of the parcels and their contents in the presence of the courier. If the parcels are clearly damaged or if the goods appear damaged/non‑conforming: the Buyer is invited to refuse delivery; failing that, the Buyer must write precise, specific reservations on the delivery note (e.g., “box dented on right side, cracked glass, part A missing”), then sign. The Buyer must inform the seller as soon as possible after delivery.

Note: Where the Buyer has chosen a carrier other than the one proposed by DesignFeu, the transfer of risk may occur upon handover to the carrier chosen by the Buyer, in accordance with applicable law.

8.2. Reporting Transport Damage, a Defect, or Non‑Conformity

To facilitate after‑sales processing, the Buyer shall send DesignFeu, as soon as possible after receipt:

  • clear, dated photos showing the parcels (sides, labels) and the damage noted on the products;
  • a list of non‑conforming or damaged parts/elements (references, quantities);
  • a brief description of the issue and, if applicable, a copy of the delivery note bearing the reservations;
  • the order number and full contact details.

Reminder: the statutory conformity guarantee covers defects arising from the goods, packaging, assembly instructions, or installation when performed by or under the responsibility of the seller. It applies for 2 years from delivery of the goods.

8.3. Seller’s Review and Response

Upon receipt of a complete file, DesignFeu acknowledges receipt and proceeds with analysis. DesignFeu informs the Buyer of its decision and the after‑sales arrangements (repair, replacement, full or partial refund where bringing into conformity is impossible or disproportionate), in compliance with statutory guarantees. When the statutory guarantee is invoked, bringing the product into conformity is carried out at no cost to the Buyer and within a reasonable time from the request.

8.4. Return/Exchange Logistics

If collection or return is necessary under the statutory guarantee, DesignFeu will arrange pick‑up at the original delivery location or provide a prepaid return label. Reasonable shipping costs incurred by the Buyer are reimbursed upon submission of proof.

If, after analysis, the damage does not fall under a guarantee or a defect attributable to the seller (e.g., mishandling after delivery), DesignFeu may offer, with the Buyer’s prior agreement, a repair or a reshipment under conditions and costs provided by quotation.

8.5. Specific Cases

  • Missing parts: dispatch of missing items or replacement of the part concerned, after verification.
  • Custom‑made products: arrangements for bringing into conformity take into account manufacturing specificities; if repair/replacement is not possible, a refund or price reduction will be proposed in accordance with the law.

Article 9. Liability

In the process of distance selling, DesignFeu is only bound by a duty of reasonable care. It cannot be held liable for damage resulting from the use of the Internet such as loss of data, intrusion, viruses, service interruption, or other involuntary problems.

Article 10. Intellectual Property

All elements of the website www.designfeu.com are and remain the intellectual and exclusive property of DesignFeu. No one is authorized to reproduce, exploit, or use in any way, even partially, any elements of the site, whether in the form of photos, logos, visuals, or text.

Article 11. Personal Data

DesignFeu undertakes to preserve the confidentiality of information provided by the Buyer, which may be transmitted for the use of certain services. All information concerning the Buyer is subject to the provisions of Law No. 78‑17 of January 6, 1978. As such, the user has the right to access, modify, and delete information concerning them. Article 12. Dispute Resolution

These distance selling terms are governed by French law. For any disputes or litigation, the competent court shall be that of Paris.
